NEW ADMINISTRATIVE INFRACTIONS CODE

As of July 1, 2002 new Code on Administrative infractions will be enforced in Russia. The Code contains several articles related to intellectual property protection and technology transfer establishing punishment for:

All articles envisage administrative fines for the said infractions.
Whereas the major part of these wrongdoings have been forbidden by the Criminal Code and main IP laws of the Russian Federation ever since 1992, the punishment for violation of the order of patenting in other countries, (i.e. filing applications for home made inventions first outside of Russia), will be introduced for the first time in the Russian Federation. The fine for this wrong is not great, though: about $150 to $300 for natural persons and about $7,500 to $11,500 for legal entities.

In contrast, violation of export control legislation will evoke fine in the amount equal to the cost of the goods, information or results of intellectual activities, unlawfully exported outside of Russia, for both natural persons and legal entities.

The fine for illegal use of a trademark will evoke fine in the amount of $250 to $300 for natural persons and $4,325 to $5,770 for legal entities. In both cases the goods bearing tha marks shall be confiscated.

Such doings as illegal use of the invention, utility model, industrial design, disclosure of the invention without consent of the proprietor and misapropriation of authorship for invention will all be punished by the fine in the amount of $435 to $575 for natural persons and $4,325 to $5,770 for legal entities.
