аааааааааааа PAYMENT OF ANNUITIESа FORа THEа EURASIAN PATENTS

 

ааааааааааааааа According to art.15(11) of the Eurasian Patent Convention (EAPC), the Eurasian patent has a unified character and is valid on the territories of all member-states of EAPC from the date of grant till the date of payment of the first annual maintenance fee. This date corresponds to the date of filing of the Eurasian patent application or the International Filing Date of PCT applications transferred to the Regional Phase in the EAPO.

ааааааааааа Pursuant to article 17 of EAPC payment of the maintenance fee shall be made annually before beginning of the year, for which the maintenance fee is envisaged by the national legislation of the elected member-state. When the maintenance fees are paid for the first time it is necessary to pay the fees in respect of all elected countries for the next year of patent validity and also for the passed years of the validity term, counted from the filing date.

ааааааааааааааа The annuities for the Eurasian patentа mustа be paid in Turkmenistan and Moldova from the first year, in Armenia Ц from the second year, and in the remaining 6 countries of EAPC Ц from the third year of theа patent validity term.

ааааааааааааааа Thus, if the Eurasian patent is granted before beginning of the second year from the date of filing the application and the patentee has chosen Turkmenistan, Moldova and Armenia, the annuities should be paid first in respect of the said states only for the first and second year of the patent. In respect of the rest of the member-states the patent will be validа without any payments till the date of payment of the annuities for the third year.

ааааааааааа However, the Eurasian patents granted on PCT applications usually issue somewhere before beginning of the fourth year counted from the filing date and as of the due date the patent holder has to pay the fees for the coming fourth year and also for all the preceding years of the patent validity.

The amounts of the annuities to be paid by the foreign holders of Eurasian patents are provided in the table below. As could be seen from the table, the fees for maintaining the Eurasian patent in respect of all countries range from $150 for the first year to $6,200 for the 19^th and the 20^th years.
