Absolute grounds for rejection of Registration of a trademark
Not alowed is registration of trademarks, consisting only of designations that:
- lack distinctive character;
- represent state flags, emblems, names of countries, etc. Such designations could be included into the trademark as non-protected elements,
if there is consent of the corresponding competent organ or the proprietor;
- are universally acknowledeged symbols and terms;
- pointing to the type, quantity, properties, destination, value of the goods, as well as the place of their production and sale;
- have acquired universal usage as designation of the goods of certain type (generic terms).
