Filing oppositions on issued patents and registered trademarks
If you know of a valid patent granted in Russia which hampers your activities on the Russian market you may try to oppose grant of the patent on the following grounds:
- patent lacks novelty or inventive level;
- the patented invention cannot be used in material production;
- patent refers to subject matter considered unprotectable under Russian Patent Law, e.g. software.
Oppositions against registration of a trademark could be filed when the mark:
- is identical or similar to your mark and relates to the corresponding goods and services;
- reproduces your company's name;
- is comprehended by the consumer as a common noun (generic term);
- destroys the distinctive features of your mark and converts it into a generic term;
- the registered mark is abused for limitation of competition;
These and other factors we may use in the oppositions prepared by our qualified stuff as grounds for requesting cancellation of grant of a patent or a trademark certificate.
