Trademark availability search

Before filing a trademark it is reasonable to find out whether identical or similar marks were already registered in Russia and in what classes. This is what the availability search is done for. For example names of literary and mythological heroes are extremely popular for certain goods and services.

The work is worth doing even in respect of well established firm names. Recently there were several scandalous controversies when Russian firms, well informed of foreign firms' plans in respect of the Russian market, registered marks identical to names of foreign firms in Russia and then demanded royalties and compensation for alleged infringement when the firms entered market.

The result of the availability search is presentation of all identical and similar marks already registered in Russia and a written opinion on whether the proposed mark could be registeredand if it is advisable to alter the classes of goods and services for registration.
