Initiating National Phase of PCT applications in Russia
The Russian legislation provides additional month for entering the National Phase of PCT applications. Therefore, the applications could be filed in Russia within 31 months of the priority date (or 21 months, if the application did not enter Chapter II PCT).
To file a PCT application in Russia and initiate the National (or Regional) Phase we will need the following materials:
- Full text of specification, drawings, and claims with amendments, if any;
- International Search Report;
- Report on International Preliminary Examination and Opinion;
In case of emergency (for example, if only several days are left before the deadline ) the National Phase might be initiated by filing just the Request form with the main data on the application. Other documents could be submitted within two months of the filing date.
If you designated the Eurasian Patent Office and want to obtain patents in two or more countries of the former USSR, it is more effective to initiate the Regional Phase in EAPO.
